Welcome to Nommelier! These Terms and Conditions ("Terms") govern your access to and use of the Nommelier mobile application and any related services (collectively, the "Service"). Please read these Terms carefully before using the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
2. Definitions

3. Account Registration and Requirements

You are responsible for safeguarding your account login credentials. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account.

The Service is intended for users who are at least 18 years old. By using the Service, you represent and warrant that you are at least 18 years old and of legal age to form a binding contract.

4.3 Wine Reviews and Ratings
Reviews and ratings submitted by users must be honest, accurate, and based on personal experience. You agree not to submit reviews or ratings that are:

False, misleading, or fraudulent

Unrelated to the wine being reviewed

Influenced by commercial factors without proper disclosure

Abusive, harassing, or harmful to wine producers, retailers, or other users
5. Intellectual Property
5.1 Service Content
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Nommelier and its licensors. The Service is protected by copyright, trademark, and other laws.
5.2 Trademarks
The Nommelier name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Nommelier or its affiliates or licensors. You must not use such marks without prior written permission.
6. Third-Party Links and Content
6.1 Third-Party Services
The Service may contain links to third-party websites or services that are not owned or controlled by Nommelier. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
6.2 Affiliate Links
The Service may include affiliate links to products, including wines. We may receive a commission if you click on or purchase through these links. All affiliate links are clearly disclosed.
7. Termination
7.1 Termination by You
You may terminate your account at any time by following the instructions on the Service or by contacting us.
7.2 Termination by Us
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.
7.3 Effects of Termination
Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
8. Disclaimers
8.1 Service Provided "As Is"
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
8.2 Availability and Accuracy
We do not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected. We do not warrant the accuracy, completeness, or usefulness of any information on the Service.
8.3 Alcohol Consumption
Nommelier promotes responsible drinking. Users should always consume alcohol responsibly and in accordance with their local laws. We do not recommend alcohol consumption for individuals under the legal drinking age or for those who are pregnant.
9. Limitation of Liability
In no event shall Nommelier, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Service

Any conduct or content of any third party on the Service

Any content obtained from the Service

Unauthorized access, use, or alteration of your transmissions or content
10. Indemnification
You agree to defend, indemnify, and hold harmless Nommelier and its licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

11. Changes to Terms

These Terms shall be governed and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.
13. Dispute Resolution
13.1 Informal Negotiations
In the event of any dispute, claim, or controversy arising out of or relating to these Terms, you and Nommelier agree to attempt to resolve such dispute informally for at least 30 days before initiating any arbitration or court proceeding.
13.2 Binding Arbitration
If the parties are unable to resolve the dispute through informal negotiations, all disputes, controversies, or claims arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of [Arbitration Authority] then in effect.
13.3 Exceptions
Nothing in these Terms shall prevent either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property, or unauthorized access to the Service.
14. Severability and Waiver

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

The failure of us to enforce any right or provision of these Terms will not be considered a waiver of those rights. No waiver of any right or provision will be effective unless in writing and signed by an authorized representative.
15. Entire Agreement
These Terms constitute the entire agreement between you and Nommelier regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
